Terms of Use

These Terms of Use (“Terms”) govern access to and use of TOCBidList.com, TFAPointsTracker.com, and the rankings, statistics, databases, analytics, and other services made available through those websites (collectively, the “Sites”).
The Sites are independently operated competitive speech and debate analytics publications.
By using a Site, you agree to these Terms to the extent permitted by applicable law.
1. Independent Publications
The Sites provide independent statistical, historical, and analytical coverage of competitive speech and debate.
The Sites are not affiliated with, sponsored by, endorsed by, or operated on behalf of any tournament host, tabulation platform, debate league, governing organization, school, or other third party referenced in their editorial or analytical content unless expressly stated otherwise.
References to third-party organizations, tournaments, services, and trademarks are used to identify the relevant organization, competition, service, source, or subject matter.
The Sites may display clearly identified advertisements and promotional material. Advertising relationships do not alter historical tournament records, rankings, points calculations, or other analytical content displayed by the Sites.
2. Public Data and Independent Compilation
The Sites independently compile, organize, and analyze factual information concerning competitive speech and debate.
Information may be obtained or verified from publicly accessible tournament records, publications, datasets, feeds, and data endpoints made available by third parties without authentication.
The Sites' data-acquisition systems are not designed to:
- use third-party account credentials to obtain tournament data;
- access nonpublic tournament records;
- impersonate an authorized user;
- circumvent authentication requirements; or
- defeat technical access controls.
Information compiled by the Sites may include:
- competitors and teams;
- schools and programs;
- tournaments and dates;
- events and divisions;
- tournament participation;
- pairings and opponents;
- preliminary and elimination rounds;
- wins and losses;
- placements and elimination stages;
- points, bids, qualifications, and rankings; and
- related factual competitive statistics.
The Sites independently normalize, combine, calculate, and analyze factual information to produce rankings, historical records, points calculations, bid tracking, school statistics, tournament statistics, and other analytics.
The Sites do not claim ownership of underlying facts merely because those facts appear in our databases.
The Sites also do not claim ownership of third-party trademarks or protected third-party expression.
The appearance of information obtained or verified through a third-party source does not imply that the source sponsors, endorses, licenses, authorizes, or is affiliated with the Sites.
Nothing in these Terms constitutes an admission concerning the ownership, protectability, contractual status, licensing status, or permitted use of information originating from a third-party source.
All rights, defenses, privileges, and remedies available under applicable law are expressly reserved.
3. Rankings, Points, Bids, and Other Analytics
The Sites may independently calculate rankings, points totals, bids, qualification indicators, school statistics, tournament histories, and other analytics from underlying factual information.
Unless expressly identified as official, calculations and rankings displayed by the Sites are unofficial.
Official tournament, league, association, or governing-body records control where they conflict with information displayed by the Sites.
4. Accuracy and Corrections
Competitive records can contain errors.
Third-party source information may be incomplete, corrected after publication, duplicated, mislabeled, or otherwise inaccurate. Our own matching and calculation systems may also make mistakes.
You may report:
- incorrect tournament results;
- records attributed to the wrong competitor or school;
- duplicate or improperly merged records;
- incorrect points, bids, rankings, or calculations; or
- other factual errors.
Correction requests may be sent to corrections@tocbidlist.com.
We may request information reasonably necessary to investigate a request.
We may correct, annotate, suppress, merge, separate, or otherwise modify records where appropriate.
The Sites should not be relied upon as the definitive source for official tournament eligibility, qualification, awards, school records, or similar official determinations.
5. Third-Party Rights
We do not intend to reproduce protected third-party material merely because factual information associated with that material is relevant to our analytics.
If you believe material appearing on a Site infringes intellectual-property or other legal rights that you hold, contact legal@tocbidlist.com and identify:
- the material at issue;
- where it appears;
- the rights you claim; and
- information allowing us to contact you.
We may investigate, modify, or remove material while reviewing a request.
Modification or removal during review does not constitute an admission of liability, infringement, or wrongdoing.
6. Use of the Sites
You may access and use the Sites for lawful informational, educational, competitive, coaching, research, journalistic, and personal purposes.
You may link to publicly available Site pages and reasonably quote or reference Site-generated rankings and statistics.
You may not:
- interfere with or disrupt operation of the Sites;
- obtain or attempt to obtain unauthorized access to nonpublic Site systems;
- circumvent Site authentication, rate limits, security systems, or technical access restrictions;
- introduce malware or malicious code;
- intentionally impose an unreasonable technical burden on the Sites;
- submit knowingly false correction, privacy, or legal requests;
- falsely claim to operate, represent, or be endorsed by the Sites; or
- use the Sites for unlawful fraud, harassment, stalking, or other unlawful conduct.
Nothing in these Terms prohibits ordinary linking, indexing, accessibility tools, research, or other lawful uses of publicly available information.
7. Site Intellectual Property
Except for underlying factual information and third-party material, the Sites' original software, design, graphics, text, calculations, methodologies, arrangement, and original presentation may be protected by applicable intellectual-property law.
Nothing in these Terms claims exclusive ownership over facts, public records, third-party trademarks, or third-party material that the Sites do not own.
8. Third-Party Services
The Sites may link to third-party websites and services.
We do not control those services and are not responsible for their availability, content, security, accuracy, privacy practices, or terms.
Use of a third-party service is governed by that service's own policies and agreements.
9. No Warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITES AND ALL INFORMATION, RECORDS, RANKINGS, STATISTICS, CALCULATIONS, AND ANALYTICS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DO NOT WARRANT THAT INFORMATION WILL BE COMPLETE, CURRENT, ACCURATE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF THE SITES AND PERSONS INVOLVED IN OPERATING THEM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE SITES.
THIS INCLUDES CLAIMS ARISING FROM:
- inaccurate tournament records;
- ranking or points errors;
- bid or qualification information;
- reliance on Site analytics;
- third-party data;
- interruptions or Site unavailability; or
- actions of third-party services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL LIABILITY ARISING FROM OR RELATING TO THE SITES WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID DIRECTLY TO USE THE SITES DURING THE PRECEDING 12 MONTHS; OR
- US $100.
Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply.
11. Changes and Availability
We may:
- correct records;
- change calculations or methodologies;
- add or remove features;
- change or discontinue data sources;
- suspend portions of a Site; or
- discontinue a Site.
We may update these Terms from time to time.
The current version will be posted with its effective date.
